Conditions of sale

These General Conditions of Sale are drawn up in Italian and govern the offer and sale of products and/or services on the website www.winternatura.com ("Site") as well as, for anything not provided for herein, the provisions of the Consumer Code and Legislative Decree no. 70/2003 and the Civil Code.
The products and/or services purchased on the Site ("Products") are sold directly by Giglio Group S.p.A.. Registered Office in Via Dei Volsci 163, 00185 Rome (RM) VAT no. IT 07396371002. REA number: MI – 2091150 Giglio Group S.p.A. manages and maintains the Site on behalf of GDPharma Srl.
Detailed information about the details that allow you to contact Giglio Group S.p.A. quickly and communicate directly and effectively with it, also in order to request information, send communications, request assistance or submit complaints, are indicated in the "Online Shop Assistance" section of the Site.

Scope of application and navigation on the Site

The offer and sale of Products on the Site constitute a distance contract governed by Legislative Decree 9 April 2003, no. 70 containing the regulations on e-commerce and by articles 45 et seq. of Legislative Decree 6 September 2005, no. 206 ("Consumer Code") and subsequent amendments.

The customer is required to carefully read these General Conditions of Sale, which Giglio Group S.p.A. makes available in PDF format at the beginning of this section of the Site, and which can be stored and reproduced, as well as all other information that Giglio Group S.p.A. provides on the Site, both before and during the purchase process.

The applicable General Conditions of Sale are those in force on the date of transmission of the purchase order. They may be modified at any time. Any changes and/or new conditions will be effective from the moment of their publication on the Site. Customers are therefore invited to regularly access the Site to check for any changes and/or updates to the General Conditions of Sale.

These General Conditions of Sale do not govern the sale of products and/or the provision of services by subjects other than Giglio Group S.p.A. that are present on the Site through links, banners or other hypertext links. Before making commercial transactions with such subjects, it is necessary to check their conditions of sale. Giglio Group S.p.A. is not responsible for the provision of services and/or for the sale of products by such subjects. Giglio Group S.p.A. does not carry out any control and/or monitoring on the websites that can be consulted through these links. Giglio Group S.p.A. is therefore not responsible for the content of such sites nor for any errors and/or omissions and/or violations of law by them.

These General Conditions of Sale are applicable in the following States: "Italy".

The Site allows each customer to browse and, with or without registration, to make purchases.

Purchases on the Site

The purchase of Products on the Site is permitted only to those who are 18 years of age or older.
The purchase of Products on the Site is permitted both to customers who qualify as consumers and to customers who do not qualify as such. Pursuant to art. 3, paragraph I, letter a) of the Consumer Code, a consumer is a natural person who acts for purposes unrelated to any entrepreneurial, commercial, professional or craft activity carried out. The inclusion of the VAT number during the purchase process is considered an indication of the purchase being made for purposes related to the entrepreneurial, commercial, craft or professional activity carried out.

The purchase of Products on the Site can be made with or without registration on the Site.

Registration on the Site is free. To register on the Site, the customer must fill out the appropriate form by clicking on "My Account".
Registration on the Site allows customers to carry out the following activities:

  • consult the status of their order online and check the "history" of orders placed (in particular, by clicking on the number of each order placed, it is possible to check the complete details of the order, including product details, shipping address and billing address; track the shipment directly from the order history;
  • manage their delivery addresses, speeding up the entry of new orders;
  • access after-sales service more quickly, by entering "online reports" directly from their order history;
  • receive product offers.

Furthermore, by accessing their personal area ("My Account"), it is always possible to:

  • manage information related to their personal profile (in particular, it is possible to change the password for accessing the reserved area);
  • modify data related to the shipping or billing address and/or add new shipping addresses;
  • change the status of their newsletter subscription.

The customer guarantees that the personal information provided during the registration process on the Website is complete and truthful, and undertakes to hold Giglio Group S.p.A. harmless and indemnified from any damage, compensation obligation, and/or penalty arising from and/or in any way connected to the customer's violation of the Website registration rules or the storage of registration credentials.
The Website is reserved for retail sales. Under no circumstances may retailers, wholesalers, or, in general, anyone intending to purchase Products for subsequent resale, make purchases on the Website.

In case of violation of the prohibitions contained in the current article, Giglio Group S.p.A. reserves the right to take all necessary actions to stop the irregularities, including suspending access to the Website, canceling the registration, or not accepting or canceling orders.

Giglio Group S.p.A. is a virtual retailer that builds its commercial offer not only on the goods present in its warehouses but also on the basis of the availability communicated by its suppliers. The Website is constantly updated automatically to ensure the maximum correspondence between the availabilities communicated by the suppliers and those indicated on the Website.
However, it may happen, also due to the possibility that multiple users purchase the same Product simultaneously, that the ordered Product is no longer available after the purchase order has been transmitted. In such a case, without prejudice to the rights attributed to the customer by law and, in particular, by Chapter XIV of Title II of Book IV of the civil code, the customer will be promptly informed by e-mail and will therefore be entitled to immediately terminate the contract, without prejudice to the right to compensation for damages, pursuant to and for the purposes of art. 61, paragraphs IV and V, of the Consumer Code. The customer who has already made the payment (see Payment Methods section) will be promptly refunded the total amount paid, including delivery costs and any other costs incurred, in relation to the order itself ("Total Amount Due").

No additional support services are provided.

Information aimed at concluding the contract

In accordance with Legislative Decree 9 April 2003, n. 70 containing provisions on e-commerce, Giglio Group S.p.A. informs the customer that:

to purchase one or more Products on the Website, the customer must fill out an electronic order form and transmit it to Giglio Group S.p.A., electronically, following the instructions that will appear from time to time on the Website;
before proceeding with the transmission of the order form, the customer can identify and correct any data entry errors by following the instructions indicated on the Website from time to time and which will accompany the different phases of the purchase; they must also accept the General Terms and Conditions of Sale;
the contract is concluded when the order form reaches Giglio Group S.p.A.'s server;
once the order form has been registered, Giglio Group S.p.A. will send the customer an "Order Registration Confirmation" e-mail to the indicated e-mail address containing: a summary of the General Terms and Conditions of Sale and the specific conditions applicable to the contract, information relating to the essential characteristics of the purchased product, a detailed indication of the price, the payment method used, delivery costs and any additional costs, as well as information on the standard instructions on withdrawal and the standard withdrawal form;
the order form will be stored in Giglio Group S.p.A.'s database for the time necessary for its execution and, in any case, within the legal terms. To access their order form, the customer can follow the procedure defined in the "Purchase orders" paragraph.
The languages available to users for concluding the contract are: Italian. Customer Service can communicate with customers in Italian and English.


Product Availability

Due to simultaneous purchases on the Website, it is possible, for technical reasons, that the Product, even if accompanied by the words "Immediate Availability," may not be immediately available after the order transmission. In any case of unavailability of the ordered Product, without prejudice to the rights attributed to the customer by law and, in particular, by Chapter XIV of Title II of Book IV of the Civil Code, Giglio Group S.p.A. will immediately notify the customer via e-mail. The customer will therefore be entitled to immediately terminate the contract, without prejudice to the right to compensation for damages, pursuant to and for the purposes of art. 61, IV and V paragraph, of the Consumer Code. The termination of the purchase contract pursuant to this paragraph entails the termination of the credit agreement, accessory to the purchase contract, possibly stipulated by the customer.

In the event that the customer exercises the right of termination referred to in art. 61, IV and V paragraph, Consumer Code, and payment of the Total Amount Due has already occurred, Giglio Group S.p.A. will refund the Total Amount Due without undue delay and, in any case, within 14 days from the termination of the contract. The refund amount will be communicated to the customer via e-mail. This amount will be credited to the same payment method used by the customer for the purchase, as provided in the "Payment Methods" section.

In the case of orders involving multiple Products ("Multiple Order"), if the subsequent unavailability concerns only some of the Products subject to the Multiple Order – without prejudice to the rights attributed to the customer by law, and, in particular, by Chapter XIV of Title II of Book IV of the Civil Code, and without prejudice to the application of the preceding paragraphs, if the subsequent unavailability concerns all the Products subject to the order – Giglio Group S.p.A. will immediately notify the customer via e-mail. The customer will therefore be entitled to immediately terminate the contract, limited to the Product and/or Products that have become unavailable, without prejudice to the right to compensation for damages, pursuant to and for the purposes of art. 61, IV and V paragraph, of the Consumer Code.

In the event that the customer exercises the right of termination referred to in art. 61, paragraphs IV and V, of the Consumer Code mentioned above, the purchase contract concerning the Product and/or Products included in the Multiple Order and which have become unavailable will be partially terminated, limited to such Product/s, with the consequent refund, if already paid, of the amount due in relation to such Products, including delivery costs, calculated as indicated in the "Delivery methods, costs and terms" section that follows, and any other additional cost due in specific relation to such Products ("Partial Amount Due"); the termination of the entire Multiple Order will be possible only in the case of evident and proven accessory nature of the Products included in the Multiple Order that have become unavailable compared to the other available Products included in the Multiple Order. The Partial Amount Due in relation to the Product/s that have become unavailable will be refunded to the customer without undue delay and, in any case, within 14 days from the termination of the contract. The refund amount will be communicated to the customer via e-mail. This amount will be credited to the same payment method used by the customer for the purchase, as provided in the "Payment Methods" section.

Product Information

Each Product is accompanied by a Technical Sheet illustrating its main characteristics based on the information provided by the product manufacturers. Giglio Group S.p.A. reserves the right to modify the Technical Sheets without prior notice.

Giglio Group S.p.A. will do its utmost to ensure that the images of the Products published on the Website, accompanying the Technical Data Sheet of a Product, represent the Products offered for sale as faithfully as possible. However, the colors of the Products may differ from the real ones due to the settings of the IT systems or computers used by users for their viewing. The images of the Product present in the Technical Data Sheet may also differ in size or in relation to any accessory products. For the purposes of the purchase contract, the description of the Product contained in the order form transmitted by the customer will prevail.

The Website may also contain general support information for purchasing, such as that found, for example, in the Glossary or the Buying Guide. Such information is to be understood as simple generic informative material, not referable to the real characteristics of a single product. For the purposes of the purchase contract, the description of the Product contained in the order form transmitted by the customer will prevail.

Prices

All prices published on the Website are expressed in Euro and are inclusive of VAT.

Giglio Group S.p.A. reserves the right to modify the price of the Products, at any time and even, possibly, several times during the same day, it being understood that the price charged to the customer will be that indicated on the Website at the time the order is placed and that any subsequent variations (increases or decreases) after its transmission will not be taken into account.

In the event that a Street Price is indicated on the Website next to the price of a Product, the latter indicates the price recommended to the public by the manufacturer through the distribution chain. Some stores or large retailers may sell such a product permanently or on offer at a lower price than that indicated on the Website. The percentage indicated next to the product, in the presence of the Street Price, is the percentage difference between the Street Price and the selling price of the Product on the Website.

Purchase orders

In the "Order Registration Confirmation" e-mail, in addition to the sales conditions, the customer will also find the 'Customer Order Number', which they must then use in any subsequent communication with Giglio Group S.p.A. as well as a summary of all the customer data entered in the order. The customer undertakes to verify its correctness and to promptly communicate any corrections via the Online Customer Service, which can be contacted by accessing the Customer Service section of the Website.

Customers who have made a purchase with registration can access their "Order Summary" and check its status via the Order History section of the Website.
Customers who have made a purchase without registration can access their "Order Summary" by following the instructions on the Customer Service page or by clicking the order history access link in the "Order Registration Confirmation" email.
From within the "Order Summary", it is possible to submit reports and/or request information via the "Online Assistance Service".

Giglio Group S.p.A. reserves the right to refuse orders originating from:

  • from a customer with whom it has ongoing legal disputes;
  • from a customer who has previously violated the conditions and/or terms of the purchase agreement with Giglio Group S.p.A.;
  • from a customer who has been involved in fraud of any kind and, in particular, in credit card payment fraud;

Giglio Group S.p.A. also reserves the right to refuse orders from customers who have provided false, incomplete or otherwise inaccurate identification data.

Credit card

Payment for Products purchased on the Website can be made by credit card directly through the Website. Credit cards accepted by Giglio Group S.p.A. will be specifically indicated on the payment method page. For payment by some credit cards, an additional fee may be required. The request for this fee and its exact amount will be, if due, clearly and specifically indicated on the payment method selection page during the purchase procedure and on the Product Data Sheet.

In the case of payment by credit card, upon conclusion of the contract, the issuing bank of the reference card will authorise the sole commitment of the amount related to the purchase made ("Authorisation"). The Total Amount Due in relation to the purchased Product will only be effectively charged to the customer's credit card the day after the shipment, even partial, of the purchased Product. However, in the case of a Product with "On Request" availability, or for other types of availability other than immediate, Giglio Group S.p.A. reserves the right to charge before shipment, in order not to let the Authorisation expire.

In all cases of contract termination and consequent order cancellation before the actual charge to the customer's credit card, Giglio Group S.p.A. will request the issuing bank of the reference card to release the committed amount through the banking systems. The release times depend exclusively on the credit card issuer and, for some types of cards, can extend up to their natural expiry, which is normally 24 days from the Authorisation date.
Once the issuing bank of the reference card has been requested to release the committed amount, under no circumstances can Giglio Group S.p.A. be held responsible for any direct or indirect damages caused by the delay in the release and/or the non-release of the committed amount by the banking system.

If, subsequent to the actual charge of the Total Amount Due to the customer's credit card, the contract is terminated, with consequent cancellation of the order, Giglio Group S.p.A. will re-credit the Total Amount Due without undue delay and, in any case, within 14 days of the contract termination.

In order to ensure the security of payments made on the Website and prevent any fraud, Giglio Group S.p.A. reserves the right to ask the customer for additional information (e.g., landline phone number, or a front/back copy of a valid identity card via email or fax).
The request email will specify the deadline by which the document must reach Giglio Group S.p.A.. This deadline will not, in any case, exceed 4 working days from the receipt of the request by the customer. Pending receipt of the requested document, the order will be suspended.
If requested, the customer is obliged to send the requested documents within the indicated deadline. If Giglio Group S.p.A. does not receive these documents within the indicated deadline or receives expired or invalid documents, the contract will be considered terminated pursuant to and for the purposes of art. 1456 of the Civil Code, and the order consequently cancelled, without prejudice to Giglio Group S.p.A.'s right to compensation for any damage it may have incurred due to the customer's non-compliant behaviour. The termination of the contract, of which the customer will be notified via email, no later than 4 working days from the expiry of the deadline for sending the documents requested by Giglio Group S.p.A., will result in the cancellation of the order and the refund of the Total Amount Due, if already paid by the customer.
If Giglio Group S.p.A. receives the requested documentation within the indicated deadline, the delivery terms applicable to the Product will commence from the date of receipt of the documentation.

At no time during the purchase procedure is Giglio Group S.p.A. able to access information regarding the customer's credit card, which is transmitted, via a protected connection, directly to the card issuer's website. No computer archive of Giglio Group S.p.A. stores such data, except, limited to data relating to the cardholder, in the case referred to in the preceding paragraph.

Paypal

Payment for Products purchased on the Website can be made using the PayPal payment solution, in accordance with the terms and conditions agreed between the customer and PayPal. In the case of payment via PayPal, the amount related to the purchase made will be debited by PayPal immediately, upon conclusion of the contract.

In all cases of contract termination and consequent order cancellation, the Total Amount Due will be simultaneously re-credited to the customer's PayPal account. The methods of re-crediting to the payment instrument linked to the PayPal account depend exclusively on PayPal. Once the amount related to the purchase made has been re-credited to the PayPal account, under no circumstances can Giglio Group S.p.A. be held responsible for any direct or indirect damages caused by delays in the actual re-crediting attributable to PayPal or the banking system.

In order to ensure the security of payments made on the Website and prevent any fraud, Giglio Group S.p.A. reserves the right to ask the customer for additional information (e.g., landline phone number, or a front/back copy of a valid identity card via email or fax).
The request email will specify the deadline by which the document must reach Giglio Group S.p.A.. This deadline will not, in any case, exceed 4 days.
Pending receipt of the requested document, the order will be suspended.
If requested, the customer is obliged to send the requested documents within the indicated deadline. If Giglio Group S.p.A. does not receive these documents within the deadline specified in the request email or receives expired or invalid documents, the contract will be considered automatically terminated pursuant to and for the purposes of art. 1456 of the Civil Code, and the order consequently cancelled, without prejudice to Giglio Group S.p.A.'s right to compensation for any damage it may have incurred due to the customer's non-compliant behaviour. The termination of the contract, of which the customer will be notified via email, no later than 4 days from the expiry of the deadline for sending the documents requested by Giglio Group S.p.A., will result in the cancellation of the order and the refund of the amount.
If Giglio Group S.p.A. receives the requested documentation within the indicated deadline, the delivery terms applicable to the Product will commence from the date of receipt of the documentation.

The data entered on the PayPal website will be processed directly by PayPal and will not be transmitted or shared with Giglio Group S.p.A.. Therefore, Giglio Group S.p.A. is unable to know and does not store in any way the credit card data linked to the customer's PayPal account or the data of any other payment instrument connected to that account.



Delivery methods, costs and terms

Products are delivered to all countries indicated in the premises of these General Terms and Conditions of Sale to the shipping address provided by the customer in the order form. However, delivery can only be made within the borders of Italy by adding a Product to the cart.

The customer is therefore obliged to enter a shipping address in the order form that is within the borders of the State associated with the country of purchase. Orders containing a shipping address outside these borders will be cancelled pursuant to and for the purposes of art. 1456 of the Civil Code, and the total amount due will be refunded, if already paid.

Delivery cannot also be made to so-called "free zones", including, by way of example, Livigno, Campione d'Italia, Ahvenanmaan lääni (FI), Açores, Madeira (PT) Ceuta, Las Palmas, Melilla, Santa Cruz de Tenerife (ES), Channel Islands (GB), nor to post office boxes or post offices. Should the shipping address be a post office box or post office or one of the indicated locations, Giglio Group S.p.A. will proceed with the termination of the contract pursuant to and for the purposes of art. 1456 of the Civil Code and the refund of the total amount due, if already paid. In case of doubts about the destination, the customer is invited to request information by reporting it by accessing the section of the Website: "Online Customer Service".

The delivery obligation is considered fulfilled by transferring the physical availability or, in any case, the control of the Products to the customer. The risk of loss or damage to the Products, due to causes not attributable to Giglio Group S.p.A., will instead be transferred to the customer when the customer or a third party designated by them, other than the carrier, physically takes possession of the Products.

Delivery costs are borne by the customer, unless otherwise indicated in the Product Data Sheet. The amount (including VAT) of these costs, which may vary depending on the delivery methods chosen by the customer, as well as the destination, number and weight/volume of the Products that the customer decides to purchase, will be expressly and separately indicated in relation to each Product in the Product Data Sheet and, in any case, before the customer submits the purchase order. This amount will finally be reported in the "Order registration confirmation" and "Shipping Confirmation" e-mails.
For the delivery of Products to certain territorial areas, specifically indicated during the purchase procedure, payment of a surcharge ("remote area shipping contribution") may be required, the exact amount of which will be clearly indicated during the purchase procedure and before the order is transmitted.

Where applicable, customs duties and charges are borne by the customer, and will not be refunded in case of termination, for any reason, of the purchase contract.In any case, the amount due for customs duties and charges, which are non-refundable in the event of termination of the purchase contract, will be explicitly stated in the purchase procedure before the customer transmits the order.

The order summary, and thus before the customer proceeds to submit the order, will indicate the total price of the order, with separate indication of delivery costs and any other additional costs. This total, which will also be indicated to the customer in the "Order Registration Confirmation" email, will constitute the total amount owed by the customer in relation to the order. Nothing more is owed by the customer beyond this amount.
In the event of partial withdrawal from Multiple Orders, the amount of delivery costs to be refunded to the customer will be calculated based on the weight of the Product subject to withdrawal, by proportionally allocating delivery costs in relation to each Product forming part of the Multiple Order and refunding those attributable to the returned Product. In any case, the amount of delivery costs to be refunded can never exceed the amount actually paid by the user.
Pursuant to art. 14 D.P.R. 445/2000 and D.L. 52/2004, for every purchase made on the Site, Giglio Group S.p.A. issues an Invoice for the material shipped, sending it via e-mail to the holder of the purchase order (attached to the "Shipping Confirmation" e-mail).
The customer can download a PDF copy of the Invoice, after the delivery of the purchased product, also in the "Order History" section.
For the issuance of the invoice, the information provided by the customer at the time of order transmission through the Site, and which the customer guarantees to be truthful, shall prevail. No changes to the invoice will be possible after its issuance.

Delivery of the ordered items is understood to be at street level, unless:

otherwise communicated by Giglio Group S.p.A. Customer Service;
as provided in the Product Technical Data Sheet;
the purchase of the upstairs delivery service, where available.
It is possible to purchase "Additional delivery services". The list of "Additional delivery services" available in relation to the individual Product, their detailed description, and the exact indication of their cost (in Euro and including VAT) will be provided in the Product Technical Data Sheet or during the purchase process, as the availability and cost of the service are often linked to the destination of the goods. In the event of exercising the right of withdrawal, all delivery costs will be refunded to the customer, including those related to any "Additional delivery services" purchased by the customer, while costs for any "Additional Services" other than "Additional delivery services", possibly purchased by the customer, will not be refunded.
If "upstairs delivery" proves impossible due to the stairs and doors not meeting the size requirements specified in the Product Technical Data Sheet or communicated by Giglio Group S.p.A. Customer Service, the Courier will deliver the Product to street level. In case of customer refusal, Giglio Group S.p.A. will still charge the delivery costs.

The customer is advised to check upon delivery:

  • that the number of packages being delivered matches what is indicated in the shipping document sent via email;
  • that the packaging is intact, undamaged, not wet, or otherwise altered;
  • that the sealing materials (adhesive tape or plastic straps) have not been tampered with in any way.

Furthermore, the customer is invited, in their own interest, to report any damage to the packaging or discrepancy in the number of packages by affixing "WRITTEN CONTROL RESERVE" and specifying the reason for the reserve (e.g., "damaged packaging", "crushed packaging", etc.) on the courier's proof of delivery.
Receipt of the Products without reservation, in fact, does not allow the customer to take legal action against the courier in case of loss or damage to the Products, except in cases where the loss or damage is due to fraud or gross negligence of the courier itself and except for partial loss or damage not recognizable at the time of delivery. In the latter case, however, the damage must be reported as soon as it is known and no later than eight days after receipt. In any case, the application of rules on the right of withdrawal and legal guarantee of conformity remains valid.

The customer is required to report any particular characteristics relating to the delivery location of the Product and/or its placement. If such information is not provided or incorrect information is provided, any additional costs that Giglio Group S.p.A. may incur to complete the delivery of the Product will be borne by the customer.

The customer acknowledges that collecting the Product is a specific obligation arising from the purchase contract. In case of failed delivery due to the recipient's absence at the address specified in the order form, after two unsuccessful delivery attempts, the package will go "into storage". In case of non-collection of the Product within five working days from the day following the day on which the courier left the delivery notice, the contract will be considered terminated and the purchase order consequently cancelled pursuant to art. 1456 c.c. Once the contract is terminated, Giglio Group S.p.A. will proceed with the refund of the total amount eventually paid by the customer, deducting the costs of the unsuccessful Product delivery, the costs of returning to Giglio Group S.p.A. and any other possible expenses incurred by it due to the day following the day on which the courier left the notice of passage. The termination of the contract and the amount of the refund will be communicated to the customer via e-mail.

Those who have failed to collect shipments more than twice, regardless of the chosen delivery or payment method, cannot make purchases on the Website. In the event that such individuals place orders in violation of this provision, the purchase contract may be considered terminated by right pursuant to and for the purposes of art. 1456 c.c. The termination of the contract will be communicated to the customer via e-mail.

Delivery times will be indicated during the purchase process, before the customer submits the order; they run from the date of order transmission, unless otherwise specified.
In the case of Multiple Orders, all Products included in the Multiple Order will be delivered simultaneously; the delivery term, in this hypothesis, will be the longest among the delivery terms of each Product included in the Multiple Order, as indicated in the relative Technical Data Sheet or during the purchase procedure, before the customer transmits the order. The delivery term of the specific order (single or multiple) will also be indicated in the Order Registration Confirmation e-mail.
In case of omitted indication of the delivery term, it will in any case take place within thirty days from the date of conclusion of the contract.
To resolve certain logistical or other issues that may arise regarding delivery, it may be necessary to contact the customer.
In any case, at the moment Giglio Group S.p.A. entrusts the shipment to the courier, the customer is notified by an SMS and an e-mail of "Shipment Confirmation". This e-mail contains all the details regarding the delivery: list of Products shipped, amount due, specific payment methods accepted by the courier in charge of delivery, Tracking number of the shipment linked to the courier's website (if available).

If the purchased Product is not delivered or is delivered late compared to the delivery terms indicated during the purchase process and in the Order Registration Confirmation e-mail, the customer, pursuant to art. 61 of the Consumer Code, invites Giglio Group S.p.A. to make the delivery within an additional period appropriate to the circumstances ("Additional Term ex art. 61, paragraph III, Consumer Code"). If this Additional Term expires without the Products having been delivered, the customer is entitled to terminate the contract ("Termination of the contract ex art. 61, paragraph III, Consumer Code"), without prejudice to the right to compensation for damages. The customer is not obliged to grant Giglio Group S.p.A. the Additional Term ex art. 61, paragraph III, Consumer Code ("Excluded Cases") if:

Giglio Group S.p.A. has expressly refused to deliver the Products;
compliance with the delivery term indicated during the purchase process and in the "Order Registration Confirmation" e-mail must be considered essential, taking into account all the circumstances that accompanied the conclusion of the contract;
the customer informed Giglio Group S.p.A., before the conclusion of the contract, that delivery by a specific date is essential.
In the Excluded Cases, if the customer does not receive the Products within the delivery term indicated during the purchase process and in the "Order Registration Confirmation", they are entitled to immediately terminate the contract, without prejudice to the right to compensation for damages ("Termination of the Contract in Excluded Cases"). The indication of the Additional Term ex art. 61, III, Consumer Code and the communication of Termination of the Contract ex art. 61, III paragraph, Consumer Code or Termination of the Contract in Excluded Cases must be communicated by the customer to Giglio Group S.p.A. at the Customer Service e-mail address. In the case of Termination of the Contract ex art. 61, III paragraph, Consumer Code or Termination in Excluded Cases, Giglio Group S.p.A. will refund the Total Amount Due to the customer without undue delay. The refund will be made using the methods indicated in the "Payment Methods" section, as applicable. If the customer does not set the Additional Term ex art. 61, III, Consumer Code or, where applicable, the Termination of the Contract ex art. 61, III paragraph, Consumer Code or the Termination of the Contract in Excluded Cases, Giglio Group S.p.A., without prejudice to the customer's ability to avail themselves at any time of such remedies and/or the ordinary means of protection provided by law and, in particular, by Chapter XIV of Title II of Book IV of the civil code, undertakes, in any case, to:

promptly notify the customer by e-mail of the delay in delivery, simultaneously indicating the new delivery date, if available, which must be accepted by the customer via e-mail;
in case of a delivery delay equal to or greater than 10 days, to recognize to the customer who requests it the refund of delivery costs and any other cost, including for "Additional delivery services" or other services purchased by the same, immediately and in any case within 10 days of the request, or, alternatively, to grant the customer a discount voucher equal to the value of the delivery costs paid by the customer, usable on the Website within 3 months.

Applicable law

The purchase contract concluded on the Website is governed by Italian law.
The application to consumer customers who do not have their habitual residence in Italy of any more favorable and mandatory provisions provided by the law of the country in which they have their habitual residence is reserved, in particular in relation to the term for exercising the right of withdrawal, the term for returning the Products, in case of exercising such right, the methods and formalities of the communication thereof and the legal guarantee of conformity.
For any dispute relating to the application, execution and interpretation of these General Terms and Conditions of Sale, the court of the place where the customer resides or has elected domicile, if the latter is a consumer, as defined by the Consumer Code, shall have jurisdiction.
The customer residing in a European Union member state other than Italy may also access, for any dispute relating to the application, execution and interpretation of these General Terms and Conditions of Sale, the European procedure established for small claims, by Regulation (EC) no. 861/2007 of the Council, of July 11, 2007, provided that the value of the dispute does not exceed, excluding interest, rights and expenses, Euro 2,000.00.
